Terms & Conditions

Phoenix Hot Yoga and Barre (The Phoenix Personal Training and Fitness, LLC) Updated 8/13/2026

These terms and conditions govern your membership, class package, drop in visit, and use of the studio and website of Phoenix Hot Yoga and Barre (Collectively referred to as “Phoenix,” “we,” “us,” or “our”). By purchasing a membership, or class package, booking a class, or attending a class at Phoenix you agree to these Terms and Conditions.

Age requirement

You must be at least 15 years of age to participate in classes at Phoenix without a parent or legal guardian present. Participants who area minor under George law but at least 15 must have a parent or legal guardian sign this agreement and the accompanying assumption of risk, waiver, liability, indemnification, and disclosure on their behalf.

Membership Dues and Billing

Upon enrollment, you authorize Phoenix to charge membership dues, class package fee, or drop in fee associated with your chosen plan to the payment method on file. If a card on file expires or a charges declined, your account will be placed on inactive hold until a valid payment method is provided, at which point any previously failed charges will be processed.

Monthly memberships automatically renew each month at the rate and effect at the time of renewal, beginning on the date of your first class under that membership (the “membership start date”). Annual memberships automatically renew each year, at 365 day intervals from the membership, start date, at the annual rate, then in effect. To cancel an automatically renewing membership, you must provide written notice by email to info@phoenixhotyogaandbarre.com at least 15 days before your next billing date. If you cancel an annual membership before the end of it then – current term, any amount paid for the remaining portion of that term is forfeited and is not refunded.

Reservation, Late Cancellation, and no-show Policy

You may cancel a class reservation up to four hours before the scheduled start time without penalty. Reservations canceled within four hours of class, and reservations you do not attend without canceling, are each subject to a $20 fee. Late cancellation and noshow fees are nonrefundable. Our door is locked. Two minutes before class begins, and clients arriving after that time will not be admitted, so that current participants are not disrupted and structures can give their full attention to the class in progress.

Suspensions and Freezes

Phoenix does not offer the option to suspend or freeze and active membership. If you are unable to attend classes for an extended period, please review the cancellation terms above.

Refunds

All membership, class package, individual class, workshop, retreat, and merchandise purchases are final. Amounts paid are nonrefundable, except for a refund is granted at the sole discretion of Phoenix.

Photography and Social Media

I consent to being photographed or filmed during yoga classes, and agree that Phoenix may use these images or videos for promotional purposes without any compensation to me.

Text Messaging Program

1. Program description: by opting in, you agree to receive recurring, automated text messages from Phoenix Hot Yoga and barre (“we,” “us,” “our”) at the mobile number you provided. Messages may include appointment reminders, updates, account alerts, promotional offers, customer support, follow ups, etc. Consent to receive these messages is not a condition of any purchase.

2. Message frequency: you may receive up to 5 messages per month. Message frequency may vary, depending on your activity and interactions with us.

3. Message and data rates: message data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your Wireless carrier for detail details about your messaging plan.

4. How to opt out and get help: you can unsubscribe the SMS service at any time by replying stop to any message we sent you after you sent stop you will receive a one time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again, using the original opt in method or reply start. For help or more information at any time, reply help to any of our messages. 5. Carrier liability disclaimer: carriers are not liable for any delay delayed or undelivered messages.

Right to Refuse Service

Phoenix reserves the right to review service too, or terminate the membership of, any client whose conduct violates our posted policies, create a safety concern for other clients or staff, or is disruptive to the studio environment. Post policies include but are limited to signs displayed verbal communication written communication via email posted on the website or the like.

Depending on the severity of the conduct, this may take the form of a verbal warning, suspension of class privileges, or immediate termination of membership without a refund.

Advance Payment Notice

George law requires that we advise you that if you pay for any part of your membership in advance, you are paying for Services to be delivered in the future, and you may lose that money if this studio ceases operations. Phoenix does not post a bond and no other protection is provided in that circumstance beyond what is described in this agreement.

Statutory right to cancel (George health spa act)

Under George’s fair business practices act, O.C.G.A Section 10-1-393.2, and it’s health spa contract provisions, you have seven business days from the date of this agreement to cancel it in full, for any reason. To cancel during this seven day period, mail or handdeliver written notice to Phoenix Hot Yoga and bar at 48 King St., suite C2, Roswell, GA 30075, or send written notice by email too info@phoenixhotyogaandbar.com, before midnight of the seventh business day after you sign the agreement. Your notice should be accompanied by any contract forms, membership, cards, and other membership documents Phoenix has given you. If you cancel within this seven day period, Phoenix will refund any payments you have made, except that Phoenix may retain the fair market value of any services you actually use before cancellation, which will not exceed $100. We recommend sending your cancellation notice anyway that lets you confirm it was received. Do not sign this waiver if there are any blank spaces above.

You may also cancel this agreement within 30 days of when you knew or should have known of a substantial change in the services available at the time you joined. A substantial change does not include a change of the class schedule or a change instructor. If you become totally permanently disabled during your membership term, you may cancel this agreement; in that case, Phoenix is entitled to a reasonable predetermined administrative fee plus the value of the services you were able to use before cancellation. If you have a history of heart disease you should consult a physician before enrolling. If you pass away during your membership term, your state may cancel this agreement. If Phoenix ceases operations and does not offer a substantially similar alternative location within 10 miles, no further payments will be owed under the agreement, including to any party that purchased a note associated with it. To cancel this agreement under any of the provisions above, send written or electronic notice of cancellation to the address email above.

Release of Liability

Your membership is conditioned on you having signed the assumption of risk, waiver, liability, and dimmed in a vacation and disclosure provided to you separately, the terms which are incorporated into this agreement as if fully set out here.

Entire agreement and modification, disagreement, together with the incorporated assumption of risk, waiver, liability, and indemnification and disclosure, is the entire agreement between you and Phoenix regarding your membership and supersedes any prior discussions or representations, whether oral or written. It may only be modified by a written agreement, signed by both parties; no verbal statement changes these terms.

Assumption of Risk, Waiver of Liability, Indemnification, and Disclosure

I, the undersigned, and voluntarily participating in hot yoga classes, bar classes, or both, and any related programs or service services (collectively, “Classes”) offered by The Phoenix Personal Training and Fitness, LLC, doing business as Phoenix Hot Yoga and bar, and it’s owners, instructors, staff, volunteers, independent contractors, and premises (collectively, “Phoenix”). I understand and acknowledge the following specific risks of participation and freely assume each of them

​Medical Conditions

Some individuals may not be suited for activities including but not limited to hot yoga, hot barre due to certain medical conditions, including, but not limited to, Cardiovascular disease, pregnancy, recent surgeries, diabetes, hypertension et. al.

Risks specific to Hot Yoga, and Hot Barre

I understand that Phoenix classes are heated. Yoga classes are conducted in a heated room, and that exercising in a heated environment carry specific risks, including, but not limited to, heat exhaustion, heat stroke, dehydration, dizziness, fainting, and elevated cardiovascular stress. I understand that these risks can occur, even if I am an experienced yoga practitioner, and that they may be more serious for participants with cardiovascular conditions, high or low blood pressure, or heat sensitivity. I am responsible for hydrating appropriately, leaving the room, if I feel unwell, and disclosing to my instructor, any condition that may affect my ability to safely tolerate a heated class. I understand that Phoenix’s barre classes are heated, use a ballet barre, can involve dynamic movements, small range movements, resistance bands, hand, weights, and other equipment, and physical positions that increase muscular endurance. I understand that this can result in falls, muscle streets, sprains, joint injury, or injury from equipment when used improperly or without proper modifications and instruction, and that I assume these risks as a condition of participating.

General assumption of risk

I understand that participation in hot yoga and barre classes requires physical exertion that may be strenuous, may cause or aggravate an existing injury or medical condition. I represent that I am in good physical condition and have no medical condition, injury or limitation that would prevent my safe participation in Phoenix‘s classes, including, but not limited to pregnancy, recent surgery, cardiovascular conditions, neck, or back injuries, or vertigo, dizziness, or fainting. I understand it is my responsibility to consult a physician before participating if I have any question about my Fitness to do so, and to inform my instructor of any relevant condition before each class begins. While at Phoenix at the studio or at any off-site location where Phoenix holds a class event, I agree to follow all posted policies, rules, and instructions communicated by Phoenix through signage, written communication, verbal instruction, or email. I understand that a violation of those policies may result in consequences ranging for a verbal warning to termination my class privileges or membership.

Release, Waiver and Indemnification

In consideration of being permitted to participate in Phoenix’s classes, I, on behalf of myself and my heirs, executors, administrators, and assigns knowingly and voluntarily release, wave and forever discharge The Phoenix Personal Training and Fitness, LLC d/b/a Phoenix Hot Yoga and Barre and its owners, officers, instructors, employees, volunteers, and independent contractors, any family related to the owner, instrucytors, staff and their family (collectively, “Releasees”), from any and all claims demands or causes of action, whether known or unknown arising out of any illness injury, damage or death that I may sustain as a result of my participation in classes or my presence at Phoenix, including claims arising from the ordinary negligence of the Releasees. This release does not extend to claims arising from the gross negligence or intentional misconduct of Phoenix or its Releasees, to the extent such a limitation is required by Georgia law. I agree to indemnify and hold harmless Phoenix and it’s Releasees from any claim brought by a third-party arising out of my participation in classes, except the extent that claim arises from the gross negligence or intentional misconduct of Phoenix or it’s Releasees.

Financial terms

I understand that all sales, including memberships, class packages, individual classes, workshops, retreats, off-site classes, and merchandise, are final. All amounts paid to Phoenix are non-refundable, and any refund, if given, is made at Phoenix’s sole discretion.

Acknowledgment

I have read this assumption of risk, waiver of liability, indemnification, and disclosure in full, I understand it’s contents, and I am signing it voluntarily. I understand that Phoenix would not permit me to participate in its classes if I did not agree to these terms, this agreement remains in effect for the duration of my relationship with Phoenix and applies to every class I attend. Periodically the terms and conditions may be updated and will be posted on the website once effective.

Website terms and conditions

By accessing www.thephoenixhotyogaandbarre.com, I assume that I accept these terms and conditions in full if I do not accept all of the terms and conditions, stated here, I will discontinue the use of the Phoenix Hot Yoga and bar website. The following applies to these terms and conditions, privacy statement, and assumption of risk, waiver of liability and indemnification and disclosure: “You,” student, your, customer, client refer to you as the person accessing this website and you accept the terms and conditions set forth by Phoenix Hot Yoga and barre (we, us, our )

I have read the terms and conditions and fully understand and agree to its contents. Not agreeing to the term terms and conditions voids participation in any and all classes, private sessions, and meetings at studio location and off-site.

Who we share your information with

We share your information with Mariana Tek, our booking and studio management platform, which processes and stores, client account, scheduling, and payment information on our behalf. We share payment card information with the payment processor that Maria A. tech integrates with in order to process your transactions; we do not separately store your full payment card number. We do not sell your personal information, and we do not share your health or medical information with any third-party except as necessary to respond to a medical emergency at the studio or as required by Law. We may also disclose your information if required to do so by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect the safety of our clients, and instructors, or at the public.

Security

We take reasonable measures to protect your personal information, including relying on the security measures Mariana Tek and our payment processor. No method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security.

Text messaging

No mobile information will be shared with third-party/affiliates for marketing/promotional purposes. All other categories, exclude, text messaging or originator opt in data and consent; this information will not be shared with any third parties. We will notify you of any changes by posting the new privacy policy on this page.
